This Alpha and Beta Testing and Confidentiality Agreement (“Agreement”) is effective as of the date you accept it (“Effective Date”). This Agreement governs your access to and use of unreleased Tark Games software, identified in the alpha or beta test sign-up communication (the “Game”), and all associated content (collectively, the “Test Materials”).

This Agreement is entered into by:

• Tark Oyun Yazılım A.Ş. (“Tark Games”, “Company”, “we”, “us”), and

• You, an individual participating as an Alpha or Beta tester (“You”).

1. Participation in Alpha or Beta Tests

By accepting this Agreement, you agree to participate in one or more Alpha or Beta Tests (“Tests”) organized by Tark Games.
This Agreement applies to each Test you join unless we require you to agree to a different version in the future.

Participation is also subject to the Terms of Use and Privacy Policy posted on our Site.
By accepting, you agree to all referenced terms.

You acknowledge that Tark Games is not responsible for any loss of data or damages arising from your participation in any Test, and you waive all such claims.

2. Access to Test Materials

• Tark Games may provide you with access to unreleased Game software (“Software”) via a Steam access key or other means.

• You agree not to share the Software, access key, or any related materials with any third party.

• You may be required to install third-party software under separate license agreements.

3. Feedback and Content

You may provide feedback, comments, ideas, suggestions, artwork, or other content (“Content”) during your participation.
You hereby grant Tark Games a worldwide, perpetual, royalty-free license to use, modify, distribute, and create derivative works based on any Content you submit.

You waive any claims of ownership, moral rights, or compensation related to your Content.

You acknowledge that your participation does not make you a co-author, partner, or employee of Tark Games, and no compensation is owed for any work or contribution.

4. Confidentiality

You agree to maintain strict confidentiality about the Game, Test Materials, and any other unpublished information you encounter (“Confidential Information”).

Without written permission from Tark Games:

• You may not discuss, stream, post, share, or otherwise reveal any information about the Game or the Tests.

• Confidentiality applies even if leaks occur by others.

You may request permission to disclose information by following the instructions we provide on official Test forums or channels.

Confidential Information does not include information already publicly disclosed by Tark Games, or lawfully obtained from a third party without confidentiality obligations.

5. Restrictions

Without express written consent from Tark Games, you agree not to:

• Copy, modify, reverse-engineer, decompile, or disassemble any part of the Game or Test Materials.

• Create modifications (“mods”) unless authorized by Tark Games for specific testing purposes.

• Distribute modifications or materials created during testing until after the official Game release.

6. Limited License

Tark Games grants you a limited, revocable, non-transferable license to use the Game solely for private, personal testing during the Alpha or Beta period.

At the end of the Test or upon Tark Games’ request, you agree to uninstall and delete all copies of the Game and related materials.

All intellectual property rights in the Game and Test Materials remain the exclusive property of Tark Games.

7. Termination

Tark Games reserves the right to:

• Suspend, modify, or terminate any Test at any time.

• Restrict or revoke your access without notice or compensation.

• Modify or delete saved games or disable access to Test versions.

You agree that breach of confidentiality or other obligations under this Agreement may cause Tark Games irreparable harm, entitling us to equitable relief (such as injunctions) in addition to legal remedies.

8. Legal Terms

• This Agreement is governed by the laws of Turkey.

• Disputes arising from this Agreement will be resolved by the courts of Istanbul, Turkey.

• This Agreement incorporates by reference our Terms of Use and Privacy Policy.

• Certain sections (Confidentiality, Feedback License, Restrictions, and Legal Terms) survive termination of this Agreement.
